Committee members adopted this decision unanimously.
The Bill (Reg.No.0961) additionally proposes to establish in specific cases, a material liability of military personnel. To this end, a demand for State compensation, from expenditure, towards his maintenance during education in the Higher Military Education Institution is applied to a. serviceman in the event that his contract is terminated early, within five years of completing his education, for the following reasons:
- incompetence in carrying out his duties;
- guilty verdict which has taken effect, deprivation of freedom, custodial restraint, stripping of military rank, or deprivation of the right to occupy certain positions;
- stripping of a military rank under a disciplinary procedure;
- systematic failure by the serviceman to fulfil the terms of his Contract.
‘We in the Committee suggest that the material liability established for cadets is also extended to officers, graduates of the Higher Military Education Institution (HMEI),who in violation of their contract, wish to be released earlier than five years after graduating from HMEI´, noted Anatoliy Hrytsenko.
Committee Members agreed that voluntary termination of contract leads to huge losses for the Army, since it is dependent on the State Recruitment Scheme, financed by the State. Those who choose to leave early, and have taken a post-graduate course in a Military College or Academy, therefore have not put into practice their skills, knowledge and intellectual potential, for the benefit of the Armed Forces of Ukraine.
‘Therefore, the said amendments to the Law create a material compensation by Officers who, for instance, chose to leave before completing their first five-year term under contract after graduation from the HMEI´, stressed Anatoliy Hrytsenko.
The People´s Deputies noted that, according to Expert reports, the compensation will run into several hundred thousand Hryvnias.
